Summary:

Riverside County ("County") owns property at 14700 Manzanita Park Road, where it operates Harmony Haven, a youth foster care facility. The District will provide an independent study program for the youth at that facility as an incidental education service, and is considering leasing 887 square feet of classroom space for this purpose. The lease runs until August 30, 2027, with a monthly rent of $887, increasing 5% annually. The County covers utilities, custodial services, and maintenance, while the District handles regulatory compliance and alterations. Both parties can terminate the lease with 90 days' notice. The District must maintain insurance and indemnify the County. The lease includes nondiscrimination, assignment restrictions, and environmental compliance. Typically, the District classroom facilities are required to comply with the Field Act, which requires approval by the Division of the State Architect (DSA). However, the District is not required to provide a Field Act-compliant facility in this instance, as the classroom facilities are exempt: (1) per Education Code section 17286, because the Harmony Haven facility, within which the classroom is located, is owned and operated by the County for purposes other than education, and the District’s use of the classroom is incidental to the primary County purpose; and (2) per Education Code section 17289, because the District is operating the classroom for an independent study program.
